Once eligible, the account may provide an online distribution request through Fidelity NetBenefits.

Before taking the entire balance in cash, we should consider the tax consequences. A taxable distribution generally becomes part of taxable income, and an early distribution may also be subject to the additional 10% tax unless an exception applies.

Leaving a job does not automatically mean that cashing out the entire 401k is required. A rollover may allow retirement assets to remain within a tax-advantaged retirement arrangement.

· Whether the distribution is taxable.

· Whether the 10% additional tax applies.

· Whether a specific IRS exception applies.

· Whether a rollover could accomplish the financial objective without creating a taxable distribution.

A cash-out can have significant tax consequences. The IRS states that a taxable distribution that is not rolled over can generally be included in income, and distributions before age 59½ can potentially be subject to the 10% additional tax.

A direct rollover to another eligible retirement plan or IRA can generally avoid current taxation on the amount properly rolled over. The IRS explains that a direct transfer can be made to another eligible plan or IRA, with no federal income-tax withholding on the transferred amount.

2. Hardship Withdrawal

hardship withdrawalsSome plans allow for an immediate and heavy financial need. Fidelity explains that the employer's plan determines whether hardship withdrawals are available and what requirements apply.

Hardship distributions generally cannot simply be returned to the 401k as a loan repayment. They can also have tax consequences and may be subject to the 10% additional tax unless an exception applies.

3. 401k Loan

If the plan permits loans, we may be able to borrow from the account rather than taking a permanent distribution. A qualifying 401k loan generally must be repaid according to the plan's terms.

However, not every 401k plan permits loans. Fidelity states that employer plans have different rules and that 401k loans are generally an option for active employees when the plan permits them.

If we are considering a Fidelity 401k loan, we should check:

· Whether the employer's plan permits loans.

· The minimum and maximum loan amount.

· The repayment period.

· The interest rate.

· The payment schedule.

· Whether payroll deductions are required.

· What happens to the loan if employment ends?

· What happens if the loan is not repaid according to the plan terms?

Fidelity 401k Hardship Withdrawal

Fidelity 401k hardship withdrawalA may be available when a plan allows distributions for an immediate and heavy financial need. Fidelity explains that the employer determines whether the plan offers hardship withdrawals and establishes the applicable requirements within the rules permitted by law.

The amount available can also depend on the plan. A hardship distribution is generally limited to the amount necessary to satisfy the qualifying financial need, subject to applicable rules. Fidelity also emphasizes that hardship eligibility should not be confused with eligibility for an exception to the 10% additional tax.

Before requesting a hardship withdrawal, we should examine whether other sources of funds are available and understand the potential effect on long-term retirement savings.

10% additional taxIf the distribution occurs before age 59½, the taxable portion may also be subject to a , unless an exception applies.

A rollover is different. When an eligible distribution is directly transferred to another qualified retirement plan or IRA, the IRS generally does not require federal income-tax withholding on the amount directly transferred.

Because tax treatment can depend on individual circumstances, we should review the distribution paperwork and current IRS rules before completing a large withdrawal.

Can We Withdraw From a Fidelity 401k Without Paying the 10% Additional Tax?

59½Potentially, yes, depending on the circumstances. Reaching age generally removes the 10% additional tax on distributions from qualified retirement plans.

The IRS also recognizes specific exceptions before age 59½. One particularly important rule applies when an employee separates from service during or after the calendar year in which the employee reaches age 55.

Other exceptions exist, but each has specific requirements. We should therefore verify the exact exception rather than assuming that a particular reason automatically eliminates the additional tax.

Important Things to Check before a Fidelity 401k Withdrawal

Before submitting a withdrawal request, we should review:

Employment status1. — Determine whether we are still employed by the plan sponsor.

Plan rules2. — confirm which withdrawal or loan options the employer's plan provides.

Age3. — determine whether the 59½ rule or another exception is relevant.

Separation date4. — if relying on the age-55 exception, confirm that the separation-from-service requirements are satisfied.

Tax consequences5. — Estimate ordinary income tax and any potential additional tax.

Rollover options6. — determine whether a direct rollover could meet the financial objective without creating current taxable income.

Vesting7. — Check the vested balance, especially employer contributions.

Existing loan8. — determine whether an outstanding 401k loan must be repaid after leaving employment.

Payment method9. — Review how the distribution will be delivered.

Documentation10. — Keep confirmation statements and tax forms for future records.

Fidelity notes that an outstanding 401k loan can become an important issue after leaving employment. If the loan is not repaid under applicable requirements, the unpaid amount can potentially be treated as a distribution, resulting in taxes and potentially the 10% additional tax for someone under 59½.
