Opening a pharmacy may look like a straightforward business idea: choose a location, register a company, hire staff and start selling medicines. In reality, a pharmacy is one of the businesses where the commercial side and regulatory requirements are closely connected.

In Latvia, a pharmacy cannot simply begin operating after company registration. It also needs a special licence, suitable premises and equipment, qualified personnel and the required documentation.

A Pharmacy Is More Than a Shop

The first interesting point is that Latvian law treats a pharmacy differently from an ordinary retail business.

A pharmacy may be established as a pharmacist's practice, a joint practice or a capital company. When operating as a capital company, specific ownership or management conditions involving certified pharmacists must be met. In particular, the law provides for situations where at least 50% of the company's capital belongs to a pharmacist or at least half of the management board consists of certified pharmacists.

This means that the corporate structure and the professional side of the business need to be considered together from the beginning.

The Licence Comes With Real Requirements

Before a pharmacy can start operating, appropriate premises, equipment, personnel and documentation must be in place. A special licence specifying the permitted field of activity is also required.

Under the current pharmaceutical licensing rules, the State Agency of Medicines makes decisions concerning pharmacy licences after assessing whether the premises, equipment, personnel and documentation meet the applicable requirements.

For an entrepreneur, this changes the way the project should be planned. Finding a promising commercial location is not enough. The location and premises also have to fit the regulatory framework applicable to pharmacies.

People Matter as Much as Premises

A pharmacy also depends heavily on qualified professionals.

As a general rule, a pharmacy is managed by a responsible manager who holds a pharmacist professional qualification certificate. Latvian legislation also contains a specific exception for certain smaller municipalities, where a pharmacist's assistant with at least five years of continuous pharmacy experience may manage a pharmacy under defined conditions.

Foreign professionals may also need to have their education and professional qualifications recognised before practising in Latvia.

Planning Before Registration Can Save Problems Later

This is why opening a pharmacy requires more planning than simply choosing a company name and submitting incorporation documents. The proposed ownership structure, premises, staffing and intended activities should be considered before the licensing process begins.

A pharmacy may begin with a business idea, but turning that idea into an operating pharmacy requires the right combination of **corporate structure, professional expertise, suitable premises and regulatory approval.
