Sexual harassment in the workplace is not always obvious at first. It may begin with inappropriate comments, unwanted attention, repeated jokes, or behavior that makes an employee uncomfortable but uncertain about whether it is “serious enough” to report. Over time, however, conduct that is ignored or minimized can become part of a hostile workplace culture. That is why employees should understand their rights early and recognize when workplace behavior may cross a legal line.

Thomas A. McKinney has represented employees in major areas of labor and employment law, including discrimination, harassment, sexual harassment, wrongful discharge, retaliation, wage and hour claims, and other employment law matters. His work with employees gives him insight into how difficult it can be for someone to speak up when the misconduct involves a supervisor, coworker, customer, vendor, or another person connected to the workplace.

Sexual harassment is generally understood as unwelcome conduct of a sexual nature that affects the workplace. It can include verbal comments, physical conduct, visual displays, sexual advances, requests for sexual favors, or retaliation after someone refuses inappropriate conduct. In New Jersey, workplace sexual harassment may involve quid pro quo harassment or a hostile work environment.

Quid pro quo harassment usually involves someone in authority tying employment benefits to sexual demands. For example, a supervisor may suggest that an employee’s promotion, schedule, raise, or continued employment depends on accepting sexual advances. A hostile work environment, on the other hand, may involve repeated or severe conduct that interferes with an employee’s ability to do their job. This can include sexually explicit jokes, inappropriate comments about appearance, unwanted touching, leering, offensive messages, or sexual rumors.

One reason harassment can be difficult to address is that employees may question whether their concerns will be taken seriously. Some fear retaliation, damage to their career, embarrassment, or being labeled as difficult. Others may believe that if no one else complains, the conduct must not be unlawful. These concerns are common, but they should not prevent employees from learning their options.

Documentation can be important. Employees who experience harassment may want to keep a record of incidents, including dates, locations, what was said or done, who was present, and whether the conduct was reported. Written communications such as emails, text messages, chat messages, or workplace complaints may also help establish what occurred and how the employer responded.

Reporting harassment according to company policy may also matter. Many employers have procedures for submitting complaints to human resources, management, or another designated person. When an employee reports harassment, the employer may have a duty to investigate and take appropriate action. If the employer ignores the complaint, fails to stop the behavior, or retaliates against the employee, that can create additional legal concerns.

Retaliation is a major issue in harassment cases. Employees should know that an employer cannot lawfully punish someone for complaining about sexual harassment or participating in an investigation. Retaliation may include firing, demotion, reassignment, reduced hours, negative reviews, pay cuts, exclusion from opportunities, or other adverse treatment connected to the complaint.

Employees should also understand that harassment does not have to come only from a supervisor. Coworkers, customers, vendors, clients, and others can contribute to a hostile work environment. Employers may still be responsible if they knew or should have known about the harassment and failed to take reasonable steps to stop it.

For workers who are unsure whether their experience qualifies as sexual harassment, speaking with an employment lawyer can provide clarity. A lawyer can review the facts, explain legal rights, identify potential claims, and help determine what steps may protect the employee’s career, reputation, and financial future.
